TERMS OF USE
1. Intellectual Property. This platform, including its source code, design, user interface, data models, compensation frameworks, classification methodology, and all associated documentation, is the exclusive intellectual property of BOSS Energy Consulting Ltd ("\u0042OSS"). All rights are reserved under the Copyright, Designs and Patents Act 1988 and applicable international intellectual property laws.
2. Prohibited Use. You may not: (a) copy, reproduce, modify, adapt, or create derivative works from any part of this platform; (b) reverse engineer, decompile, or disassemble any code, algorithms, or data models; (c) scrape, harvest, or systematically extract data; (d) use insights, methodology, or frameworks to build a competing product or service; (e) share login credentials or provide access to unauthorised third parties; (f) remove or alter any copyright notices, watermarks, or proprietary markings.
3. Data Contribution & Census. By participating in the Climate Tech Census or contributing salary data, you grant BOSS a perpetual, irrevocable, worldwide licence to use such data in anonymised, aggregated form for platform improvement, report generation, diversity analysis, and market intelligence. Individual responses are never identifiable. Diversity data (gender, nationality, expat status) is collected exclusively for aggregated reporting and analysis — no individual can be identified from census outputs.
4. Disclaimer. Market data represents benchmarks and trends. Actual compensation decisions remain at your discretion. BOSS does not provide legal, tax, or accounting advice. AI-generated estimates have inherent limitations and should be used alongside professional judgement.
5. Enforcement. BOSS reserves the right to terminate access and pursue legal remedies, including injunctive relief and damages, for any breach of these terms. This agreement is governed by the laws of England and Wales.
6. No Competing Use. Users may not use salary data, market intelligence, classification frameworks, or any methodology from this platform to build, inform, or contribute to any competing compensation intelligence product, salary database, or recruitment technology without prior written consent from BOSS Energy Consulting Ltd.
PRIVACY POLICY (UK GDPR / DATA PROTECTION ACT 2018)
7. Data Controller. BOSS Energy Consulting Ltd is the data controller. Contact: michael@boss-energy.co. Our registered address is available on request.
8. What We Collect & Why. (a) Sign-up data (name, email, company, role, location, company stage, team size) — collected under legitimate interest (Art. 6(1)(f) UK GDPR) to provide access to the platform, send quarterly reports, and facilitate recruitment enquiries. (b) Census/contribution data (job title, salary, function, seniority, subsector, country, diversity fields, talent mobility fields) — collected under consent (Art. 6(1)(a)). This data is fully anonymised at the point of aggregation and cannot be traced back to individuals. (c) CV request data (role requirements, budget, contact details) — collected under contract/pre-contractual necessity (Art. 6(1)(b)) to deliver recruitment services.
9. Special Category Data. Gender and nationality data collected in the Census qualifies as demographic data processed under explicit consent (Art. 9(2)(a)). It is used exclusively for aggregated diversity reporting. You may decline to provide this data (select "Prefer not to say").
10. Data Storage & Security. Sign-up and Census data is stored in Google Sheets (Google Workspace, EU data centres, covered by UK adequacy regulations). No data is sold to third parties. AI-powered features use the Anthropic API — queries are sent to Anthropic's servers for processing but are not stored or used for model training (per Anthropic's commercial API terms).
11. Data Retention. Sign-up data: retained for the duration of your relationship with BOSS plus 24 months. Census data: retained indefinitely in anonymised, aggregated form (individual responses are not identifiable). CV request data: retained for 12 months or until the recruitment engagement concludes.
12. Your Rights (UK GDPR). You have the right to: (a) access your personal data; (b) rectification of inaccurate data; (c) erasure ("right to be forgotten"); (d) restrict processing; (e) data portability; (f) object to processing; (g) withdraw consent at any time. To exercise any right, email michael@boss-energy.co. We will respond within 30 days.
13. Cookies & Session Storage. This platform uses sessionStorage (cleared when you close the browser tab) to maintain your sign-in state. We use a cookie consent preference stored in localStorage. We do not use tracking cookies, advertising cookies, or third-party analytics cookies unless you have enabled analytics (in which case Google Analytics or Plausible may set cookies — see our cookie banner).
14. International Transfers. Data may be transferred to the United States (Anthropic API for AI features) under Standard Contractual Clauses. Google Workspace data is stored in EU/EEA data centres.
15. Complaints. If you believe your data protection rights have been violated, you may lodge a complaint with the Information Commissioner's Office (ICO): ico.org.uk, Tel: 0303 123 1113.
16. Build ID. BOSS-CHI-2026-MJ-002. Each instance carries a digital fingerprint for IP protection.
